De conformidad con la Ley Federal de Protección de Datos en Posesión de Particulares (en lo sucesivo, la “Ley”), por lo tanto, el presente documento deberá ser interpretado conforme a la legislación aplicable en la república mexicana y no debe confundirse o sobreponerse a diversas legislaciones nacionales.  

WERCOS ENTERTAINMENT SOCIEDAD ANÓNIMA DE CAPITAL VARIABLE, (en lo sucesivo, “WERCOS”) establece que el presente Aviso de Privacidad está dirigido a todos los que utilicen los servicios de WERCOS mediante el uso de la aplicación móvil denominada WERCOS MEDIA (en lo sucesivo “LA APLICACIÓN")

El presente Aviso de Privacidad establece la información sobre los datos en posesión de WERCOS y serán aplicables para los usuarios de LA APLICACIÓN (en lo sucesivo, los “USUARIOS”).

1. I.Definiciones 

1. A.“USUARIOS” / “usted”: o cualquier compañía o entidad legal que acepta los Términos y Condiciones de WERCOS y se suscribe a los Servicios descritos en los mismos al utilizar LA APLICACIÓN. 

1. B.“Consentimiento”: Manifestación de la voluntad del titular de los datos mediante el cual se efectúa el tratamiento de estos. 

1. C.“Datos personales”: Cualquier información concerniente a una persona física identificada o identificable. 

1. D.“Servicio”/“Servicios”: Aquellos descritos en el apartado “Servicios que proporciona WERCOS”. 

1. E.“Ley”: Ley Federal de Protección de Datos Personales en Posesión de los Particulares (legislación aplicable en la república mexicana). 

1. F.“Tratamiento”: La obtención, uso, divulgación o almacenamiento de datos personales, por cualquier medio. El uso abarca cualquier acción de acceso, manejo, aprovechamiento, transferencia o disposición de datos personales. 

1. G.“Derechos ARCO”: El derecho que tienen los Titulares de Datos Personales, para solicitar el acceso, rectificación, cancelación u oposición sobre el tratamiento de sus datos. 

1. H.“WERCOS”/“nosotros”: Proveedor de los Servicios y propietarios de LA APLICACIÓN.  

1. II.RESPONSABLE. 

De acuerdo con el Aviso de Privacidad, el RESPONSABLE será WERCOS & PARTNERS SOCIEDAD CIVIL, con domicilio en calle Paseo de los Tamarindos 384, 9°-999, Colonia Campestre Palo Alto, Cuajimalpa de Morelos, Ciudad de México CP 05119, México.  El RESPONSABLE estará encargado del Tratamiento de Datos Personales de los USUARIOS de LA APLICACIÓN.

1. III.DATOS PERSONALES. 

La información obtenida por WERCOS (los “Datos Personales”) se recopilará y encriptará exclusivamente a través de los procesos de autenticación y verificación de identificación digital de LA APLICACIÓN de forma segura, para los fines descritos en este Aviso de Privacidad.

Los Datos Personales de los USUARIOS recopilados por WERCOS incluyen lo siguiente:

     Para los USUARIOS en general:

• ●Nombre completo, en su caso. 

• ●Número de teléfono o de teléfono celular. 

• ●Edad. 

• ●Género, en su caso. 

• ●Datos de identificación. 

• ●Cualquier información que el USUARIO proporcione a WERCOS de forma voluntaria. 

Asimismo, el USUARIO, reconoce que derivado de la naturaleza de LA APLICACIÓN, puede existir la posibilidad de que información personal sea proporcionada para efectos de la creación de sopas de letras para uso y disfrute del USUARIO y de otros usuarios, dicha información no forma parte de los datos personales protegidos por el presente documento y la responsabilidad de publicar o no información personal dentro de sopas de letras queda estrictamente ligada al USUARIO y no a WERCOS.

Los derechos del USUARIO en relación con el contenido que suben a LA APLICACIÓN, como su nombre en el perfil, y/o cualquier otro contenido que derive directamente del USUARIO, no cambian. No reclamamos la propiedad del contenido que publicas con relación a los aspectos mencionados anteriormente y puedes compartirlo con quien estimes conveniente donde lo consideres oportuno. No obstante, debes concedernos ciertos permisos legales (“licencia”) para que podamos proporcionar el Servicio dentro de LA APLICACIÓN. Cuando compartas, públicas o subes contenido protegido por derechos de propiedad intelectual o industrial (como textos, palabras, o cualquier otro contenido) en nuestro Servicio o en relación con este, de conformidad con el presente acuerdo, nos concedes una licencia mundial, no exclusiva, transferible, sublicenciable y libre de regalías por derechos de autor para alojar, utilizar, distribuir, modificar, mantener, reproducir, traducir y mostrar o comunicar públicamente tu contenido, así como para crear obras derivadas (de acuerdo con tu configuración de privacidad y de la aplicación). La licencia se extinguirá cuando el contenido se elimine de nuestros sistemas.

El USUARIO, tiene la opción de eliminar su cuenta dentro de LA APLICACIÓN, en todo momento, pero deberá enviar una solicitud a la siguiente dirección de correo electrónico webmaster@wercos.com en caso de que desee eliminar el contenido creado por él, para que no pueda ser visualizado o utilizado por otros usuarios dentro de LA APLICACIÓN, de lo contrario el USUARIO comprende que las sopas de letras creadas con anterioridad a la eliminación de su cuenta, podrán quedar dentro de la biblioteca digital de LA APLICACIÓN y dependiendo de la privacidad seleccionada por el USUARIO, estas podrían ser utilizadas por otros.

No puede el USUARIO publicar información privada o confidencial de otra persona sin su permiso ni realizar acciones que vulneren los derechos de terceros, incluidos los de propiedad intelectual e industrial (por ejemplo, infracciones relacionadas con los derechos de autor o marca, falsificaciones o artículos pirateados); así como contenido racista, sexista, xenófobo, violento, vulgar u ofensivo en general o en particular, hacia cualquier individuo, colectivo, creencia, de manera implícita o explícita.

El USUARIO podría utilizar la obra de otra persona de conformidad con las limitaciones o excepciones establecidas en la legislación sobre derechos de autor y otros derechos relacionados, en el marco de la normativa aplicable en México.

El USUARIO representa a su propia persona o ha obtenido todos los derechos necesarios en relación con el contenido que publicas.

Los usuarios de LA APLICACIÓN deben tener en cuenta que pueden generar dentro ella contenido que puede ser usado por otros usuarios, no solo dentro de la misma APLICACIÓN, sino también mediante ligas de internet que redirijan a la misma.

El USUARIO acepta expresamente que en caso de que proporcione datos sensibles a WERCOS  con el fin de crear una cuenta para acceder a los Servicios prestados por WERCOS, el USUARIO otorga su consentimiento expreso y por escrito de que sus datos sensibles sean Tratados por WERCOS, en términos del Artículo Octavo de la Ley Federal de Protección de Datos en Posesión de Particulares.

1. IV.FINES DEL TRATAMIENTO DE DATOS PERSONALES. 

Los Datos Personales del USUARIO serán utilizados para los siguientes fines:

Identificación digital de usuarios de forma segura, creada a través de medios electrónicos sobre los cuales ejerce control exclusivo, que ligan un grupo de datos de acceso seguro con las plataformas con las cuales WERCOS tenga un acuerdo de colaboración;

Verificación de la información y documentos proporcionados por el Titular contra bases de datos gubernamentales, públicas o privadas.

Realizar evaluaciones periódicas de nuestros productos y servicios con el fin de mejorar la calidad de estos.

Evaluar la calidad del servicio que ofrecemos, en general, para cumplir con las obligaciones que hayamos contraído con el USUARIO.

El uso de datos personales para proporcionar publicidad en línea adecuándose a cada usuario para ofrecer una experiencia dentro de LA APLICACIÓN más satisfactoria para cada USUARIO

Fines estadísticos y de información para WERCOS.

1. V.LIMITACIONES AL USO O REVELACIÓN DE SUS DATOS PERSONALES. 

     El USUARIO puede solicitar a WERCOS que limite el uso o tratamiento de sus Datos Personales o de los Titulares de los Datos. Para hacerlo, el USUARIO debe enviar una solicitud por escrito a la dirección de correo electrónico: webmaster@wercos.com

Esto último siempre en el entendido de que los datos personales o información privada que el USUARIO suba a LA APLICACIÓN por medio de las sopas de letras o servicios que se ofrece en esta, pueden ser revelados o compartidos derivado del uso que el USUARIO elija, por lo tanto, se debe diferenciar entre los datos personales de los cuales WERCOS tiene absoluto control y cuales fueron compartidos o revelados por el USUARIO fuera del alcance de WERCOS

1. VI.DERECHOS ARCO DEL USUARIO. 

1. a)Acceso a los Datos Personales; es decir, solicitar a WERCOS que permita al USUARIO conocer qué datos se encuentran en su posesión. 

1. b)Rectificación de cualesquier Datos Personales sujetos a Tratamiento y en posesión de WERCOS que sean incorrectos, incompletos, erróneos y/o imprecisos. 

1. c)Cancelación de cualesquier Datos Personales en posesión de WERCOS. 

1. d)Oposición al Tratamiento realizado por WERCOS. 

1. e)Para estos efectos, el USUARIO deberá enviar una solicitud al siguiente correo electrónico webmaster@wercos.com con, al menos, los siguientes requisitos: 

1. 1.Nombre y domicilio del USUARIO o algún otro medio confiable para comunicarle la respuesta de cualquier solicitud relativa a sus Derechos ARCO; 

1. 2.Los documentos que autentiquen la identidad del USUARIO, o su representación legal en su caso; 

1. 3.La descripción clara y precisa de los Datos Personales con respecto a los cuales el USUARIO pueda ejercer cualesquiera de los derechos mencionados; y 

1. 4.Cualquier otro elemento o documento que simplifique la localización de los Datos Personales. 

1. VII.NOTIFICACIONES RELATIVAS A CAMBIOS A LA POLÍTICA. 

WERCOS puede modificar este Aviso de Privacidad, siempre y cuando se respeten las disposiciones legales aplicables. Cuando el Aviso sea modificado, WERCOS pondrá a disposición del USUARIO la información sobre los cambios, así como el nuevo Aviso de Privacidad, en formatos físico o digital dependiendo del caso concreto; o el USUARIO puede ser notificado mediante correo electrónico a la cuenta con la cual el usuario se haya registrado. WERCOS se reserva el derecho de cambiar y actualizar este Aviso de Privacidad, el USUARIO es responsable de mantener esta cuenta actualizada y de asegurarse que las notificaciones se hayan recibido en una bandeja de entrada que se revise continuamente.

Es responsabilidad del usuario leer el Aviso de Privacidad, ya que al utilizar el sitio web de WERCOS se entenderá que acepta los términos de este, y en caso de no recibir del USUARIO una respuesta dentro de un periodo de 72 horas, se entenderá que el USUARIO acepta los cambios que este Aviso de Privacidad pueda tener.

In accordance with the Federal Law on Protection of Data Held by Private Parties (hereinafter, the “Law”), Therefore, this document must be interpreted in accordance with the legislation applicable in the Mexican Republic and must not be confused or superimposed on various national legislations.

WERCOS ENTERTAINMENT SOCIEDAD ANÓNIMA DE CAPITAL VARIABLE, (hereinafter, “WERCOS”) establishes that this Privacy Notice is directed to all those who use WERCOS services by using the mobile application named WERCOS MEDIA (hereinafter “THE APPLICATION") and/or the services within the same.

This Privacy Notice establishes the information about the data in possession of WERCOS and will be applicable to THE APPLICATION users (hereinafter, the “USERS”).

1. I.Definitions 

1. A.“USERS” / “you”: or any company or legal entity that accepts the WERCOS Terms and Conditions and subscribes to the Services described therein. 

1. B.“Consent”: Manifestation of the will of the owner of the data through which the processing of these data is carried out. 

1. C.“Personal data”: Any information concerning an identified or identifiable natural person. 

1. D.“Service”/“Services”: Those described in the “Services provided by WERCOS” section. 

1. E.“Law”: Federal Law on Protection of Personal Data Held by Private Parties (the legislation applicable in the Mexican Republic). 

1. F.“Processing”: The obtaining, use, disclosure, or storage of personal data, by any means. Use covers any action of access, handling, use, transfer, or disposition of personal data. 

1. G.“ARCO Rights”: The right that Personal Data Holders must request access, rectification, cancellation, or opposition to the processing of their data. 

1. H.“WERCOS”/“we”: Service Provider and owners of THE APPLICATION. 

1. II.RESPONSIBLE. 

In accordance with the Privacy Notice, the RESPONSIBLE will be WERCOS & PARTNERS SOCIEDAD CIVIL, with address on the street name Paseo de los Tamarindos 384, 9°-999, Colonia Campestre Palo Alto, Cuajimalpa de Morelos, Mexico City ZC 05119, México. The RESPONSIBLE will oversee the Processing of Personal Data of the USERS within THE APPLICATION.

1. III.PERSONAL DATA. 

The information obtained by WERCOS (the “Personal Data”) will be collected and encrypted exclusively through the authentication and digital identification verification processes of THE APPLICATION in a secure manner, for the purposes described in this Privacy Notice.

USER Personal Data collected by WERCOS includes:

     For the general USERS:

• ●Full name, if applicable. 

• ●Telephone or cell phone number. 

• ●Age. 

• ●Gender, if applicable. 

• ●Biometric facial recognition features. 

• ●Identification data. 

• ●Any information that the USER provides to WERCOS voluntarily. 

Likewise, the USER recognizes that derived from the nature of THE APPLICATION, there may be the possibility that personal information is shared for the purposes of creating word searches for the use and enjoyment of the USER and others, said information is not part of personal data. protected by this document and the responsibility of whether to publish personal information within word searches is strictly linked to the USER and not to WERCOS.

The rights of the USER in relation to the content they upload to THE APPLICATION, such as their name in the profile and/or any other content derived directly from them, do not change. We do not claim ownership of the content you publish in relation to the aspects mentioned above and you can share it with whoever you deem appropriate wherever you consider appropriate. However, you must grant us certain legal permissions (“license”) for us to provide the Service within THE APPLICATION. When you share, publish or upload content protected by intellectual or industrial property rights (such as text or words)  within our Service, in accordance with this agreement, you grant us a worldwide, non-exclusive, transferable, sublicensable and royalty-free to host, use, distribute, modify, maintain, reproduce, translate and publicly display or communicate your content, as well as to create derivative works (in accordance with your privacy and application settings). The license will terminate when the content is removed from our systems. You can delete individual pieces of content or, if you delete your account, all your content at once.

The USER has the option to delete their account within THE APPLICATION, at any time, but must send a request to the following email to the following address webmaster@wercos.com in case they wish to delete the content created by them, so that it cannot be viewed or used by other users within THE APPLICATION, otherwise the USER understands that the word searches created prior to deleting their account may remain within the digital library of THE APPLICATION and depending on the privacy selected by the USER, these could be used by others.

The USER cannot publish private or confidential information of another person without their permission or take actions that violate the rights of third parties, including intellectual and industrial property rights (for example, infringements related to copyright or trademark, counterfeits, or pirated articles); as well as racist, sexist, xenophobic, violent, vulgar or offensive content in general or in particular, towards any individual, group, belief, implicitly or explicitly.

The USER may use another person's work in accordance with the limitations or exceptions established in the legislation on copyright and other related rights, within the framework of the applicable regulations in México.

The USER represents itself or has obtained all necessary rights in relation to the content you post or share.

Users of the APPLICATION should be aware that they can generate content within it that can be used not only within the same APPLICATION, but also through Internet links that redirect you to it.

The USER expressly accepts that if they provide sensitive data to WERCOS In order to create an account to access the Services provided by WERCOS, the USER gives his express written consent for his sensitive data to be Processed by WERCOS in terms of Article Eight Federal Law on Protection of Data Held by Private Parties.

1. IV.PURPOSES OF TREATMENT OF PERSONAL DATA. 

The USER Personal Data will be used for the following purposes:

Secure digital identification of users, created through electronic means over which it exercises exclusive control, which links a group of secure access data with the platforms with which WERCOS has a collaboration agreement.

Verification of the information and documents provided by the Owner against government, public or private databases.

Carry out periodic evaluations of our products and services to improve their quality.

Evaluate the quality of the service we offer, in general, to comply with the obligations we have contracted with the USER.

The use of personal data to provide online advertising adapted to each user to offer a more satisfactory experience within THE APPLICATION for each USER.

Statistical and information purposes for WERCOS.

1. V.LIMITATIONS ON THE USE OR DISCLOSURE OF YOUR PERSONAL DATA. 

The USER may request WERCOS to limit the use or processing of its Personal Data or that of the Data Owners. To do so, the USER must send a written request to the email address:

The latter always with the understanding that the personal data or private information that the USER uploads to THE APPLICATION through the word searches or services offered therein, may be revealed, or shared derived from the use that the USER chooses, for example. Therefore, a distinction must be made between personal data of which WERCOS has absolute control and which were shared or revealed by the USER outside the reach of WERCOS.

1. VI.ARCO RIGHTS OF THE USER. 

1. a)Access to Personal Data; that is, request WERCOS to allow the USER to know what data is in their possession. 

1. b)Rectification of any Personal Data subject to Processing and in possession of WERCOS that are incorrect, incomplete, erroneous and/or imprecise. 

1. c)Cancellation of any Personal Data in possession of WERCOS. 

1. d)Opposition to the Treatment carried out by WERCOS. 

1. e)For these purposes, the USER must send a request with to this email: webmaster@wercos.com at least, with the following requirements: 

1. 1.Name and address of the USER or some other reliable means to communicate the response to any request related to their ARCO Rights. 

1. 2.The documents that authenticate the identity of the USER, or their legal representation if applicable. 

1. 3.The clear and precise description of the Personal Data with respect to which the USER can exercise any of the rights; and 

1. 4.Any other element or document that simplifies the location of Personal Data. 

1. VII.NOTIFICATIONS REGARDING CHANGES TO THE POLICY. 

WERCOS may modify this Privacy Notice if the applicable legal provisions are respected. When the Notice is modified, WERCOS will make information about the changes, as well as the new Privacy Notice, available to the USER, in physical or digital formats depending on the specific case; or the USER may be notified by email to the account with which the user has registered. WERCOS reserves the right to change and update this Privacy Notice, the USER is responsible for keeping its account up to date and ensuring that notifications have been received in an inbox that is continually reviewed.

It is the user's responsibility to read the Privacy Notice, since by using the WERCOS website it will be understood that they accept its terms, and if they do not receive a response from the USER within a period of 72 hours, it will be understood that the USER accepts the changes that this Privacy Notice may have.
